Underpaid Fire Loss

Our client’s home was burned in an accidental fire.  The insurance company delayed paying and, when it finally paid, didn’t pay enough to replace the home.  We fought for additional living expense, building coverage, lost rental income, and other available coverage.  After going through an appraisal and then filing a lawsuit, we were able to recover over $450,000 from the insurance company.

Common Reasons Insurance Claims are Denied in Dunedin

If you're like most people, you probably have insurance to protect yourself and your property in case of an emergency. But what happens when your insurance company denies your claim? Insurance companies deny claims for a variety of reasons. Some of the most common reasons include:

  • The insurance company says you didn't have the right coverage
  • The insurance company says your claim is not covered by your policy
  • The insurance company says your claim is too small to pay
  • The Insurance company says you waited too long to file your claim
  • The Insurance company says you can't prove your loss

If your insurance claim has been denied, you may be feeling frustrated and helpless. But don't give up! An experienced insurance dispute lawyer can help you get the compensation you deserve.

Insurance companies are in business to make money, not to pay claims. They have teams of adjusters and lawyers whose job it is to deny claims or pay out as little as possible. You need a lawyer on your side who knows how to navigate the insurance claim process and fight for your rights.

The attorneys at Herman & Wells are experienced insurance dispute lawyers who have successfully represented many clients in Dunedin and throughout Florida. We know how to deal with insurance companies and their tactics. We will thoroughly review your policy and gather all the evidence needed to build a strong case on your behalf.

Do Insurance Companies Underpay Claims for Similar Reasons?

Insurance companies are for-profit businesses. They generate income by collecting premiums and then investing that money. Insurance companies also want to make a profit, which means they try to pay out as little as possible on claims.

Some insurance companies use similar tactics to underpay different types of claims. For example, auto insurance companies may undervalue property damage claims after an accident. Homeowners' insurance companies may lowball the cost of repairs after a hurricane. And health insurance companies may refuse to pay for certain treatments or services.

If you have an insurance policy, you expect the company to act in good faith and pay what it owes you. Unfortunately, that's not always the case. Insurance companies often wrongfully deny or underpay valid insurance claims.

If your insurance company has denied your claim or offered a low settlement, you may be able to recover the money you're owed by filing a lawsuit. The Insurance Dispute Attorneys at Herman & Wells can help. We have experience handling all types of insurance disputes and will fight to get you the compensation you deserve.

Signs Your Insurance Agent May Have Acted Negligently

If you've been involved in an accident, you're likely working with an insurance agent to file a claim. Insurance agents are supposed to be helpful and advocate on your behalf to get you the best possible outcome. Unfortunately, not all insurance agents have your best interests at heart. If you suspect your insurance agent may have acted negligently, here are some signs to look for:

  • Your claim has been denied
  • The insurance company is offering you a low settlement
  • You feel like you're being pushed into a settlement
  • The insurance company is delaying payment on your claim
  • You're not getting straight answers from the insurance agent

If you're experiencing any of these issues, it's important to speak with an experienced insurance dispute lawyer. An insurance dispute lawyer can help you navigate the claims process and make sure you get the compensation you deserve.

Insurance agents have a duty to act in good faith when handling claims. If you believe your insurance agent has acted negligently, contact Herman & Wells today to schedule a consultation. We're here to help you get the compensation you need to move on with your life.

Timeline for Property Damage Insurance Claims in Dunedin

After a Dunedin, Florida property owner files an insurance claim, the insurance company will have a timeline of events that they must follow. This timeline is set by the state of Florida and is in place to ensure that both the policyholder and the insurance company are treated fairly.

The first step in the process is for the insurance company to acknowledge receipt of the claim. They have 14 days to do this. Once they have acknowledged receipt, they will then have 30 days to investigate the claim and make a decision.

If they decide to deny the claim, they must provide a written explanation of their decision within 14 days. If they decide to approve the claim, they must notify the policyholder within 30 days and provide a written estimate of the damages.

Once the policyholder receives the estimate, they have 90 days to accept or reject it. If they accept it, the insurance company will have 30 days to pay out the claim. If the policyholder rejects the estimate, they have 60 days to file a lawsuit.

If you find yourself in a situation where your insurance company is not following this timeline, you may need to hire an insurance dispute attorney. An experienced attorney can help you navigate the process and ensure that you are treated fairly.
